Terms and Conditions of Sale

All Products and Services you purchase from the relevant North and/or South American Fluke entity specified in the offer or order acknowledgement (“Fluke”) are governed by the applicable Fluke Terms and Conditions listed below, unless you have a separate signed agreement with Fluke for that Product and/or Service or the Product is otherwise subject to separate terms or end user license agreement (EULA) provided by Fluke. By placing an order with Fluke, you agree to be bound by the applicable Fluke Terms and Conditions. Please select the applicable Fluke Terms and Conditions below to review the terms that apply to your purchase.

If you purchased any Products, then the Terms and Conditions for Products apply to your order. “Products” include equipment, hardware, parts, and software and exclude Services, Support Plans, software-as-a-service, and any subscription-based product, hardware or service.

If you purchased any Services, then the Terms and Conditions for Services apply to your order. “Services” are Fluke performed services and exclude Products, Support Plans, software-as-a-service, and any subscription-based product, hardware or service.

If you purchased a Support Plan, one or more of the Terms and Conditions for Support Plans apply to your order. “Support Plans” include: (a) programs that provide for technical support services and benefits covering Met/Team, Met/Connect, and/or Met/Cal software, and (b) programs that provide for technical support services, repair, calibration, and other benefits covering Fluke Calibration, Networks, and Industrial Group hardware. Support Plans exclude Products, Services, Extended Warranty, software-as-a-service, and any (non-Support Plan) subscription-based product, hardware or service.

If you purchased an Extended Warranty, then the Extended Warranty Program Terms and Terms and Conditions for Services apply to your order. “Extended Warranty” is a program that provides Pruftechnik Products that are out-of-warranty with technical support services, repair, calibration, and other benefits. Extended Warranty excludes Products, Services, software-as-a-service, and any other Support Plan or non-Support Plan subscription-based product, hardware or service.

If you purchased a subscription to CalStudio Calibration Management Software, then the CalStudio Terms of Service apply to your order.

If you purchased Fluke Condition Monitoring software and/or Watchman analysis services, then the Master Terms for Goods and Services apply to your order, including any related Products or Services purchased under the order. Products or Services, including standalone alignment Services, purchased without Fluke Condition Monitoring software and/or Watchman analysis services are excluded and remain subject to the Terms and Conditions for Products or Services, as applicable.

If you purchased an OptiCal measurement capture tool subscription as part of your Met/Support Preferred subscription, then the OptiCal Addendum governs your use and access to the OptiCal service.
